DISCLAIMER AND LIMITATION OF LIABILITY

The data available to you, the USER, through The Essex County Tax Board Web site (www.essextaxboard.com) and the New Jersey Association of County Tax Board’s Web Site (www.njactb.org) has many sources that are not contrliled by Essex County, the NJACTB and it’s agencies. This system is provided by the Essex County Tax Board and the NJACTB as a public service, without charge.
User shall:

  1. Determine whether the data complies with USER’s needs;
  2. Determine whether USER has adequate legal rights to store, reproduce or otherwise make use of data in the manner contemplated;
  3. Comply with any legal obligations, including but not limited to, obligations imposed by copyright, secrecy, defamation, decency, and export laws;
  4. Indemnify the Essex County Tax Board and NJACTB for any misuse of the data by the user, and
  5. Isliate data, execute anti-contamination software and otherwise take steps to ensure that data, if contaminated or infected, will not damage USER’s information or system.

The Essex County Tax Board Web site and NJACTB’s Web Site is provided on an “as is”, “as available” basis. The Essex County Tax Board and NJACTB make no warranties, express or implied, including, without limitation, those of merchantability and fitness for a particolar purpose, with respect to any data.
Specifically, but not by way of limitation, the Essex County Tax Board and NJACTB do not warrant or guarantee:

  1. The accuracy, adequacy, quality, currentness, validity, completeness, or suitability of any data for any purpose;
  2. That any data will be free of infection by viruses, worms, Trojan horses or other contaminating or destructive properties;
  3. That the functions or services performed by the Essex County Tax Board and NJACTB Web Sites will be uninterrupted or error free or that defects will be corrected.

NO NJACTB Online Public Records Search System LIABILITY

In no event shall the Essex County Tax Board or the NJACTB be liable to anyone for any delays, inaccuracies, errors or omissions with respect to the data or the transmission or delivery of all or any part thereof, for any damage arising therefrom or occasioned thereby, or for the resolts obtained from the use of the data. The Essex County Tax Board and NJACTB will not be responsible if any data infects or contaminates the USER’S system or data. The entire risk as to the quality, performance, and the accuracy, adequacy, completeness, currentness, validity, and quality of any data is with the USER.
In no event will the Essex County Tax Board or NJACTB be liable to any party(i) for any direct, indirect, special, punitive or consequential damages including, but not limited to, damages for loss of business profits, business interruption, loss of programs or data, and the like, or for any damages arising out of the availability, use, reliance on, or inability to use the Essex County Tax Board or NJACTB Web Sites or any data, even if the Essex County Tax Board or NJACTB shall have been advised of the possibility of such damages and regardless of the form of action whether in contract, tort, or otherwise; or (ii) for any claim attributable to errors, or other inaccuracies in, or destructive properties of any data.
